Collapse ▲Four federal civil rights statutes condition the receipt of federal financial assistance on recipients’ compliance with a mandate not to discriminate in programs or activities: Title VI of the Civil Rights Act of 1964, as amended; Age Discrimination Act of 1975; Section 504 of the Rehabilitation Act of 1973, as amended; and Title IX of the Education Amendments Act of 1972.
The aforementioned laws provide that no person in the United States shall, on the ground of race, color, national origin, sex, disability or age, be subject to discrimination under any program or activity receiving Federal financial assistance.
NC State and NC A&T receive “federal financial assistance” from the USDA through grant programs including HATCH and Evans-Allen Research and Smith Lever, EFNEP, and 1890 Extension. As such, the entire NC State College of Agriculture of Life Sciences and the NC A&T College of Agriculture and Environmental Sciences are subject to the applicable provisions of these statutes and their implementing regulations.
Civil Rights Act of 1964, Title VI Prohibits discrimination on the basis of race, color, and national origin in programs and activities receiving federal financial assistance.
Education Amendments of 1972, Title IX Prohibits discrimination on the basis of sex under any education program or activity receiving Federal financial assistance.
Age Discrimination Act of 1975 Prohibits discrimination on the basis of age in programs or activities receiving Federal financial assistance.
Rehabilitation Act of 1973, Section 504 Prohibits discrimination on the basis of disability in programs receiving federal financial assistance.
In addition to our requirements as recipients of federal financial assistance. as state universities, NC State and NC A&T are also subject to Title II of the Americans with Disabilities Act.
The Americans with Disabilities Act of 1990, Title II Requires state/local governments to give people with disabilities an equal opportunity to benefit from all of their programs, services, and activities.
The USDA Office of the Assistant Secretary for Civil Rights (OASCR) provides leadership and direction for the fair and equitable treatment in all USDA federally conducted or federally assisted programs while ensuring the delivery of quality programs and enforcement of civil rights. USDA regulations and directives provide guidance on the implementation of federal nondiscrimination laws. The USDA Office of the Assistance Secretary for Civil Rights provides information on the available complaint process.
